1. Agreement to These Terms

OpenBoxTracker ("the Service") is a website at openboxtracker.com operated by AxiumFoundry ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service Does

The Service monitors publicly listed open box inventory on Micro Center's website for the stores you select, displays those listings in one place, and sends you email alerts when products you track appear as open box items.

3. Not Affiliated with Micro Center

The Service is an independent tool. We are not affiliated with, endorsed by, or sponsored by Micro Center or Micro Electronics, Inc. "Micro Center" and all product names, images, and trademarks shown in the Service belong to their respective owners and are used only to identify stores and products.

4. Listings Can Be Wrong or Out of Date

Open box inventory changes constantly. The Service collects listing data periodically, so prices, conditions, and availability shown may be stale, incomplete, or incorrect, and an item may sell, be repriced, or be removed at any time. Always confirm price and availability with the store before traveling or making a purchase. We do not guarantee that the Service will detect every deal or that any alert will reach you in time to act on it.

5. Your Account

• You must provide a valid email address; it is how we deliver alerts and account messages.
• Keep your password confidential. You are responsible for activity that happens under your account.
• You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to purchase a subscription.
• Tell us at [email protected] if you believe your account has been accessed without your permission.

6. Plans, Billing, and Cancellation

• The Free plan includes a limited number of stores and tracked SKUs, as described on the Plan page.
• The Pro plan is a monthly subscription billed through Stripe, our payment processor. It renews automatically each month until you cancel.
• You can cancel at any time from the billing portal on the Plan page. Cancellation takes effect at the end of the current billing period, and you keep Pro features until then. Except where required by law, fees already paid are not refunded.
• We may offer trial or promotional access to Pro features. When it ends, Free plan limits apply unless you subscribe.
• If your plan no longer covers everything you track, the extra stores or SKUs are paused, not deleted.
• We may change prices or plan limits. If we increase the price of your subscription, we will notify you in advance by email or through the Service, and the change will take effect no earlier than your next billing period.

7. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose;
• access or attempt to access another user's account;
• probe, disrupt, or overload the Service, or interfere with its operation;
• access the Service with bots, scrapers, or other automated tools, or harvest data from it, except through features we provide;
• circumvent rate limits, plan limits, or other technical restrictions;
• resell, republish, or commercially redistribute data obtained from the Service.

Some features (such as on-demand scans and product lookups) are rate limited to keep the Service responsive for everyone.

8. Intellectual Property

The Service's software, design, and branding belong to us. We claim no ownership of Micro Center listings, product information, images, or trademarks displayed by the Service.

9. Termination

You may stop using the Service at any time and may request deletion of your account by emailing [email protected]. We may suspend or terminate your account if you violate these Terms or if necessary to protect the Service or other users, with notice where practical. Sections of these Terms that by their nature should survive termination (including disclaimers and limitations of liability) survive.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost savings, or missed deals, arising out of or relating to the Service. Our total liability for all claims relating to the Service is limited to the greater of $10 or the amounts you paid us in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before they take effect. The "Last updated" date above reflects the current version. Using the Service after changes take effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of the United States and of the state in which AxiumFoundry is based, without regard to conflict-of-law rules.
